Missouri SB 973: What Changed for Homeowners and Investors.
Missouri SB 973 took effect on August 28, 2026. It changes how "we buy houses" contracts, contract assignments and sale-leasebacks work in Missouri, and it tightens tax sale rules. Here is what it means in plain English, for homeowners and for investors.
If you are a homeowner
Some cash buyers do not plan to buy your house. They sign a contract with you, then sell that contract to another investor for a fee. SB 973 now protects you in these deals.
14-day disclosure. At least 14 calendar days before you sign, the wholesaler must give you a written disclosure. It must be separate from the contract, in bold, at least 12-point type, and signed and dated by both of you.
Right to cancel. If they skip the disclosure, you can cancel any time before closing, with no penalty. Your earnest money must be returned within 30 days.
No waivers. These rights cannot be signed away. A contract clause that tries is void.
Sale-leasebacks. If you sell your home and rent it back, the buyer must give you a disclosure 14 days before signing and a signed copy within 5 days, and title cannot transfer until 30 days after signing. You can cancel in writing, without penalty, up to closing, and any payments are refunded. Violations can cost the buyer up to $10,000 each.
Questions to ask any cash buyer: Are you buying this house yourself, or selling the contract? Can I see proof of funds? Did you give me the SB 973 disclosure at least 14 days ago?
If You Are an Investor
The disclosure duty applies to residential property with 1 to 4 units, and expecting a fee is enough to make you a wholesaler.
The disclosure goes to the record owner on title, not just whoever lives there. The 14 days are calendar days, weekends included.
A violation is an unlawful practice under the Missouri Merchandising Practices Act. The seller can sue, and so can the Attorney General.
Tax sales: vacant residential property found vacant for 6 months can be sold with no redemption, bidders pay a new $200 fee, and land banks may now sell back to original owners and their relatives.
Things to Make Sure To Tell Your Seller: That you are intending to make a profit on the sale and that you intend to sell the contract to the end buyer. If you are doing a leaseback or attempting to wholesale in Kansas or a different state, additional disclosures may apply.
Why Lucas?
A listing with a licensed agent is not a wholesale deal. If you are a homeowner weighing a cash offer, I will show you the cash number and the listed number side by side. If you are an investor, I can represent you on purchases and run boots-on-the-ground work through KC Boots.
